Agreement to Terms

By accessing or using Foundation ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Description of Service

Foundation is a platform for creating, managing, and collaborating on Product Requirements Documents (PRDs) and Technical Design Documents (TDDs). The Service includes AI-powered features to assist with document creation.

Account Responsibilities

When you create an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code or content
  • Violate the rights of others, including intellectual property rights
  • Use the Service to harass, abuse, or harm others
  • Resell or redistribute the Service without authorization

Your Content

You retain ownership of all content you create using the Service, including PRDs, TDDs, and other documents. By using the Service, you grant us a limited license to:

  • Store and process your content to provide the Service
  • Display your content to authorized collaborators
  • Create backups for data protection purposes

You are responsible for ensuring you have the right to upload and share any content you create or import into the Service.

AI Features

The Service includes AI-powered features that assist with document creation. Regarding these features:

  • AI suggestions are provided as assistance, not professional advice
  • You are responsible for reviewing and validating all AI-generated content
  • AI outputs may not always be accurate or complete
  • We do not guarantee specific outcomes from AI features

AI Data Handling

For Foundation-managed AI features, we route LLM requests through OpenRouter only to providers and models with Zero Data Retention (ZDR):

  • Your content is processed solely to generate responses
  • Your prompts and outputs are not used to train AI models
  • The LLM provider does not retain your data after processing each request
  • We track token usage for billing but do not log prompt content

If your organization configures a Bring Your Own Key (BYOK) provider, its data handling is governed by that provider's terms and privacy policy.

Payment and Billing

For paid plans:

  • Fees are billed in advance on a subscription basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • You are responsible for all applicable taxes

Intellectual Property

The Service, including its design, features, and technology, is owned by Foundation and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service without our written permission.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Termination

We may suspend or terminate your access to the Service:

  • For violations of these Terms
  • For non-payment of applicable fees
  • If required by law
  • At our discretion with reasonable notice

You may terminate your account at any time through your account settings. Upon termination, you may request an export of your content.

Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and changing the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Foundation is incorporated, without regard to conflict of law principles.
